On August 17, 2021, Dr. Raul David Davila was arrested in Lee County on one sexual battery (felony) and two battery (misdemeanor) charges for allegedly touching three of his female patients in a sexually inappropriate manner during treatment. Davila was arrested and then released from Lee County Jail on a $30,000 bond. Raul Davila, a pain-management doctor, has his own private practice located at 8192 College Pkwy, Suite A18 in Fort Myers, FL 33919. He has been a licensed medical doctor in Florida since 1999.

In August 2022, Davila’s medical license was revoked by the State of Florida Board of Medicine on account of these same sexual misconduct complaints. According to media reports, three alleged victims came forward to law enforcement reporting that Dr. Davila, age 66, inappropriately touched them during treatment for pain management. All three victims claim that they have been patients of Davila for over a year before the incidents occurred.

Lee County Sheriff’s Office released a statement that one alleged victim went for her regularly scheduled appointment with Davila on July 6, 2021 at Pines Medical Center. She claims Davila used a “massage gun” on her back while laying face-down on her stomach and made contact with her vagina. Davila then allegedly touched her inappropriately using his finger to penetrate her vagina, according to the charging document. The victim reacted to the inappropriate touching by telling Davila “no” and leaving the room. She was then brought into another room by Davila, where he asked her to keep what happened a secret. The report states that Davila said he blamed her for the incident because she “is so beautiful.”  On October 5, 2023, Dr. Davila was acquitted in a jury trial in Lee County on this sexual battery charge.  Dr. Davila still faces two misdemeanor charges described below.

The second alleged victim told police officers that on January 13, 2021, she saw Davila for her monthly appointment. She claims that he withheld her medications until she sat on his lap. After doing so, Davila allegedly rubbed his hands on her back, down to her buttocks, and inside her underwear.

A third victim accused Davila of pulling down her pants, exposing her underwear, and pulling down the side of her shirt, exposing one of her breasts on March 11, 2020. The patient stated that the visit started as normal. She paid $200 in cash at check-in, had her vitals taken by a front desk worker, and then was escorted into a room to meet Davila to stretch. The victim claims that Davila told her not to tell anyone that he touches her because, technically, he isn’t a licensed physical therapist. She said that she had been a patient of Davila’s for about a year without issue, but that visits became increasingly inappropriate.

Dr. Davila was also accused of battery in 2013 by a female patient at Lee County Medical Solutions in Fort Myers.  He was not criminally charged in that incident.

Finding the right medical provider can be challenging. We seek out seasoned professionals who possess a good bedside manner, compassion, and empathy.  When we do finally decide on one, we hope to feel better over time, not be violated by the very person with whom we place our trust. Doctors hold a position of power in the physician-patient relationship under Florida law.  It is both unacceptable and unlawful for a healthcare professional to touch a patient in any sexual manner or practice any sexual misconduct while treating the patient.

Horowitz Law has filed numerous sexual misconduct claims against medical professionals on behalf of patients who were inappropriately touched in their care.  Under no circumstances is a doctor or nurse permitted to have sexual contact with a patient.  If you have been a victim of sexual assault or sexual battery at a medical office or facility, or if you know someone who has, please contact our law firm at 888-283-9922 or send an e-mail to sexual abuse lawyer Adam Horowitz at [email protected] for a free consultation.
