Jupiter Chiropractor, Hamed Kian, Arrested For Practicing With Suspended License Due to Sexual Misconduct

In April 2022, Dr. Hamed Kian was arrested in Palm Beach County and now faces seven counts of unlicensed practice of health care profession. Kian, 41, was a staffed Chiropractor at Capstone Chiropractic Center located at 1200 Town Center Dr, Jupiter, FL 33458. He has been a licensed medical doctor in Florida since 2011.

In September 2018, the Board of Chiropractic Medicine entered a Final Order imposing discipline against Dr. Kian’s license by placing Dr. Kian on indefinite probation with monitoring due to multiple allegations of sexual misconduct with female clients. The order stated Kian was to undergo an evaluation with the Professionals Resource Network (PRN) and to comply with any and all recommendations of PRN; ordering him to complete and pass a National Board of Chiropractic Examiners Ethics and Boundaries course. Dr. Kian was permanently prohibited from examining or treating female patients unless the examination and/or treatment was witnessed in full by a Board-approved licensed female chaperone to ensure that Dr. Kian was following orders.

In March 2021, the Board of Chiropractic Medicine placed an Emergency Order on Kian’s license due to additional complaints of sexual misconduct with female clients that occurred after the initial Order was in place. Not only did Kian violate proper ethics and code by assaulting his patients, but Kian also did not follow the restrictions placed on his Final Order. Each of the complaints received after the intial Final Order stated that Kian was alone in the treatment room without any supervision. Kian also did not comply with any and all recommendations of PRN. The Order stated that Kian was no longer allowed to practice or treat any patients in the state of Florida.

In January 2022, another investigation into Kian began by Jupiter Police after they received a complaint from a woman who claimed Kian gave her an unwanted kiss after an appointment she had the prior week. JPD also received a report from an investigator from the Florida Department of Health stating that she was made aware that Kian was still practicing even with a suspended license. There are seven patients that have come forward saying they were treated by Kian without supervision since his license was revoked.

According to his arrest report, Kian’s reported abuse dated back to 2016. In 2017, one woman alleged she went to Kian’s office at Capstone to be seen by a massage therapist. After the appointment, Kian saw her and told her to undress. The woman said that Kian touched her inappropriately and pulled off the sheet to expose her private area twice during the treatment. She also said Kian tried to kiss her, but she turned her head and he kissed her cheek. Police filed the case as sexual battery with the State Attorney’s Office who declined to file the case. Another complaint was received in 2020, which brought about his initial restricted license and then his Emergency Order. On July 28, 2021, at Capstone, Dr. Kian provided chiropractic treatment to another female patient. The client was laying face down in her underwear and during the treatment session, Dr. Kian took the woman’s cell phone and entered his phone number. He told her to call him anytime. She returned multiple times since that incident and claims that they were alone in the room without supervision. During another treatment session, Kian touched and rubbed the patient’s genital area and the outside of her labia. This went on for at least fifteen minutes. She claimed that Kian told her that the pubic bone was connected to the head and needed massaging.

In August 2021, the same patient reported to Jupiter Police that she saw Kian multiple times and believed his behavior “to be inappropriate.” She said that her final treatment occurred at her apartment because she was in so much pain. She stated that Kian arrived alone, without supervision. He asked if they could go in the bedroom, but the patient told him to use the couch. Kian proceeded to remove her yoga pants, making her a bit uncomfortable, and he told her, “Oh now we are being modest, I have seen you naked before.” She never saw Kian again and his license was revoked just two months later.

Doctors hold a position of power in the physician-patient relationship under Florida law.  It is both unacceptable and unlawful for a healthcare professional to touch a patient in any sexual manner or practice any sexual misconduct while treating the patient.
