Pembroke Pines Taekwondo Instructor Robert Franco Arrested For Hidden Cameras in Bathroom

On Friday, August 6, 2021, Robert Franco, a martial arts instructor in Pembroke Pines, surrendered himself to the Broward County Jail after a warrant was issued for his arrest. According to Pembroke Pines police, Robert Franco, ago 64, allegedly placed hidden cameras in the restroom of his academy, Master Franco’s Taekwondo Academy, located at 11090 Pines Boulevard.

Investigators reported that on July 29th, 2021, a 17-year-old female student of Franco’s noticed two hidden cameras inside of picture frames on a shelf in the bathroom of his Taekwondo academy. The student took pictures of the hidden cameras and then confronted Robert Franco, who then destroyed the picture frames and hidden cameras. The student then called her father and told him what happened. He quickly came to the academy and called 911.

Authorities arrived within the hour and began their investigation against Franco, searching through a seized phone and computer. Police said the content they have obtained thus far included video of children and adults. Authorities believe the cameras had been in the restroom since March when Franco took over the academy. 

According to the Local 10 News report, Franco gave an explanation for having the cameras, but police said that explanation was not reasonable. The Pembroke Pines police ask anyone who attended or visited, or whose children attended or visited, Master Franco’s Taekwondo Academy and used the restroom to come forward.

“The cameras were certainly positioned in such a fashion that not only was the level of trust violated but so too was their level of privacy,” said Adam Feiner with the Pembroke Pines Police Department. He also added that the police department fully anticipates more victims to come forward and need the communities to help to do so.”

Franco is facing multiple charges of video voyeurism and was charged with tampering or fabricating physical evidence. Franco’s bond was set at $20,000.

Florida Pediatrician Arrested on Federal Child Pornography Possession To Be Held Without Bond

In a hearing held on Monday, March 1, 2021, Dr. Michael Mizrachy, a pediatrician in Broward County, was ordered pre-trial detention and is to remain in custody without bond pending his federal trial on federal child pornography charges. If convicted on the federal charge, Mizrachy faces up to 20 years in prison. Mizrachy also faces a pending state criminal case in connection with the alleged conduct. 

In June 2020, investigators with the Broward Sheriff’s Office Internet Crimes Against Children (ICAC) were sent a tip alleging that Dr. Mizrachy, then employed at West Broward Pediatrics, may be in possession of and possibly distributing child pornography. Mizrachy has been a licensed pediatrician in Florida since 2000. He last worked for West Broward Pediatrics. At a preliminary hearing, Mizrachy was ordered not to have contact with minors.

In October 2020, detectives obtained a search warrant for Mizrachy’s home in Parkland. They discovered that Dr. Mizrachy used an app, KIK, to chat with a child who was 15 years old and that the chats included sexually explicit photographs. Further investigation revealed that the other photos of the children located within Mizrachy’s accounts were of his daughters’ friends at his home. These photos included the children’s clothed private parts. Most of the children appeared to be between the ages of 13 and 15, and one of them was ten years old.

Attorney Adam Horowitz continues to advocate for the Florida Department of Heath to restrict the professional licenses of health care professionals when they are accused of sexual crimes.  Allowing such practitioners access to patients needlessly endangers the public.

On Tuesday, January 26, 2021, Dr. Stewart Bitman, a gastroenterologist of thirty years who has been affiliated with many hospitals in Broward and Miami-Dade counties, was arrested and criminally charged for allegedly sending sexually explicit photos of himself to a 13-year-old.  Dr. Stewart Bitman was booked at the Broward County Main Jail and faces three counts of transmission of material harmful to a minor and one count of solicitation of a minor. Bitman has been licensed to practice medicine in Florida since 1990.  At a bond hearing on January 27, Dr. Bitman’s bond was set at $80,000 ($20,000 for each criminal charge) and he was ordered to have no contact with minors and prohibited from traveling outside of South Florida.  No emergency orders restricting his medical license have been entered yet by the Florida Department of Health. 

According to media reports, a joint investigation with Broward Sheriff’s Office Internet Crimes Against Children (ICAC) detectives and Coral Springs Police Department began in April 2020. The investigation revealed that Bitman sent sexually explicit messages and photographs to an underage girl.  Detectives believe Bitman knew he was communicating with a minor, and while attempting to solicit victims, he portrayed himself as a teenage boy.

Officers reported that the texts revealed Bitman to be sitting at a desk/table in front of a computer with his drawstring shorts/pants and white underpants pulled down below his genitals. The text that is displayed across the picture says, “How many classes RU having each day?”

A SWAT team carried out a search of Bitman’s Parkland home on January 26, taking the doctor into custody and seizing multiple electronic devices for further analysis. Bitman had an office in Coral Springs (3001 Coral Hills Dr. Suite 250, Coral Springs, FL 33065) with Digestive CARE according to his state medical license. The investigation is ongoing. Detectives are working to identify any additional victims with whom Bitman may have communicated.

In June 2020, investigators with the Broward Sheriff’s Office Internet Crimes Against Children (ICAC) were sent a tip alleging that Dr. Mizrachy of West Broward Pediatrics may be in possession of and possibly distributing child pornography.  Mizrachy has been licensed as pediatrician in Florida since 2000.  He last worked for West Broward Pediatrics. According to a statement released by the Sheriff’s Office, the detectives found a video depicting child pornography. “In addition to the initial video described in the tip, detectives located several photos depicting what appear to be young children in their bathing suits, underwear or shorts in which none of the children appear to be aware the photos were being taken,” the statement said.

FLORIDA NURSE FIRED FOR VIDEO VOYEURISM

On Tuesday, November 24, 2020, a Florida nurse was arrested for allegedly placing a hidden camera in a public restroom at the drug rehab facility where he worked. Davidson Rozier, age 33, of Lauderhill, was charged with video voyeurism, the act of secretly recording someone in an intimate state, without permission, usually for purposes of sexual interest or gratification.

According to the arrest report, the investigation began in early January when another employee at 1st Step Behavioral Health in Pompano Beach, found a small camera hidden inside a box of tissues. It had been placed on the back of a toilet in the rehab clinic’s unisex restroom. When clinic managers reviewed the footage, they saw Rozier’s face and badge as he set up the camera.  Rozier was immediately fired that same day. 1st Step Behavioral Health is a licensed dual-diagnosis long-term care facility that focuses on physiological rebalancing of the individual through medical, physical, emotional, mental and spiritual care.

Davidson Rozier’s nursing license was suspended, two days later, when the rehab center reported Rozier to the Department of Children and Families and Florida Department of Health. He had worked at 1st Step Behavioral Health since July 2018. Upon review of the video footage, investigators found images of at least one person who was filmed unknowingly while using the bathroom.

According to Florida Statute 810.145, the most basic charge of video voyeurism occurs when an individual:

“For his or her own amusement, entertainment, sexual arousal, gratification, or profit, or for the purpose of degrading or abusing another person, intentionally uses or installs an imaging device to secretly view, broadcast, or record a person, without that person’s knowledge and consent, who is dressing, undressing, or privately exposing the body, at a place and time when that person has a reasonable expectation of privacy.”

Healthcare facilities have an obligation to make sure their providers are helping, not harming their patients. Someone who violates patients’ rights has no place working in the nursing field. Any facility in which such a crime is committed must take responsibility for failing to properly screen potential employees and safeguard their patients.

Florida Health Department Bars Broward County Gastroenterologist From Seeing Female Patients

The Florida Department of Health issued an Emergency Order restricting gastroenterologist Subhash Gupta after he allegedly inappropriately touched a woman during an emergency room exam.  Dr. Gupta was practicing medicine in Pompano Beach, Florida.  He has been licensed to practice medicine in Florida since 1983.

According to the Florida Department of Health, Dr. Subhash Gupta touched a 58-year-old patient’s breasts without warning or a stethoscope after she came into the emergency room with a diagnosis of abdominal inflammation.  He repeated the same exam on the woman two other times, according to the emergency restriction order. The health department said Dr. Gupta’s exam was outside the scope of practice and was intended for Dr. Gupta’s around or sexual gratification.

Under the restriction order, Dr. Gupta cannot treat female patients.  Public records reveal Dr. Gupta was previously disciplined for performing an upper gastrointestinal endoscopy on a patient without her consent. Additionally, in 1993, Dr. Gupta was disciplined for providing inadequate medical care to seven patients and poor record keeping.

Deerfield Beach Pastor Maurice Lyn Arrested For Fondling 15-Year Old Boy

Maurice Dave Lyn, the Pastor at Church of God of Prophecy in Deerfield Beach, has been arrested on lewd and lascivious charges for allegedly kissing and and fondling a a 15-year old boy.  The incident, which was charged as a Second Degree Felony, is alleged to have occurred on August 6, 2019, when the Pastor took the boy to shopping for school supplies.  After shopping, the two had lunch and then returned to the teenage boy’s apartment in Coral Springs where they were alone.  At the apartment, Lyn reported pushed the boy against a counter and started kissing and fondling the boy who resisted his advances.

According to law enforcement records, when the boy’s mother confronted Lyn about molesting her son, Lyn said he was “praying and fasting for forgiveness.”  Lyn, originally from Jamaica, came to the United States in 2002 and is the senior pastor at Deerfield Beach Ministries.
