Dr. Stewart Bitman Arrested

After Sending Explicit Photos to a Minor

Stewart Bitman Horowitz Law

On Tuesday, January 26, 2021, Dr. Stewart Bitman, a gastroenterologist of thirty years who has been affiliated with many hospitals in Broward and Miami-Dade counties, was arrested and criminally charged for allegedly sending sexually explicit photos of himself to a 13-year-old.  Dr. Stewart Bitman was booked at the Broward County Main Jail and faces three counts of transmission of material harmful to a minor and one count of solicitation of a minor. Bitman has been licensed to practice medicine in Florida since 1990.  At a bond hearing on January 27, Dr. Bitman’s bond was set at $80,000 ($20,000 for each criminal charge) and he was ordered to have no contact with minors and prohibited from traveling outside of South Florida.  No emergency orders restricting his medical license have been entered yet by the Florida Department of Health.

According to media reports, a joint investigation with Broward Sheriff’s Office Internet Crimes Against Children (ICAC) detectives and Coral Springs Police Department began in April 2020. The investigation revealed that Bitman sent sexually explicit messages and photographs to an underage girl.  Detectives believe Bitman knew he was communicating with a minor, and while attempting to solicit victims, he portrayed himself as a teenage boy.

Officers reported that the texts revealed Bitman to be sitting at a desk/table in front of a computer with his drawstring shorts/pants and white underpants pulled down below his genitals. The text that is displayed across the picture says, “How many classes RU having each day?”

A SWAT team carried out a search of Bitman’s Parkland home on January 26, taking the doctor into custody and seizing multiple electronic devices for further analysis. Bitman had an office in Coral Springs (3001 Coral Hills Dr. Suite 250, Coral Springs, FL 33065) with Digestive CARE according to his state medical license. The investigation is ongoing. Detectives are working to identify any additional victims with whom Bitman may have communicated.

HEALTH DEPT. ORDERS EMERGENCY LICENSE RESTRICTION OF CORAL SPRINGS ACUPUNCTURIST

FLORIDA DEPARTMENT OF HEALTH ORDERS EMERGENCY LICENSE RESTRICTION OF LOCAL ACUPUNCTURIST

On July 2, 2020, the Florida Department of Health ordered the emergency restriction of the license of Sergio H. Garcia, (Dr. Garcia) to practice acupuncture in the state. Garcia is co-founder of SAGA (Service of Acupuncture Guided by Angels), located at 10718 Wiles Rd, Coral Springs, FL 33076.

According to the Emergency Order, in late April 2020, Garcia was sexually inappropriate with a female patient while giving her a treatment. After placing the needles, he gave her a full body massage, and told the patient he was giving her a tantric massage. He then “massaged” her vaginal and breast areas.  On two occasions, he allegedly penetrated the patient’s vagina with his finger.  According to the Order, he told her he was removing energy blocks from her body and then kissed her forehead. The Department of Health says that at no point during the session did Garcia ask permission of the patient to touch her in such a manner.

Such brazen acts are outside the scope of acupuncture practice and are considered to be sexual misconduct which is against the law. The Department of Health found Garcia’s continued unrestricted practice as an acupuncturist, poses an immediate danger to the health and well being of Florida’s citizens. As such, a proceeding for disciplinary action against Garcia will be instituted.

The stresses of life can easily overwhelm us. When patients book an acupuncture appointment it is to manage pain, decompress and relax. They trust that the acupuncturist treating them is carefully vetted and safe. It is both unacceptable and unlawful for any employee to violate the trust of patients and touch them in a sexual manner.

Horowitz Law has filed numerous sexual misconduct claims against health care professionals on behalf of clients who were inappropriately touched during their appointment. Twins Gymnastics Coral Springs

Five Girls Accuse Man at Twins Gymnastics in Coral Springs of Molestation

Five girls between the ages of 7 and 10 who were enrolled at Twins Gymnastics in Coral Springs have accused the gym owners’ brother, Leonardo Suarez Alvarez, of molestation over a two year period.  Twins Gymnastics is owned by twin sisters Maria Elena and Maria del Carmen Suarez.  The police reports stated that Leonardo Suarez Alvarez volunteered at the gym.  He would reportedly clean the gym and also drive the kids to classes at the gym.

Suarez Alvarez was arrested on September 27 on five charges of lewd and lascivious molestation of a victim under age 12.   He is being held in Broward County without bond as he is a citizen of Ecuador and prosecutors argued he is a flight risk.  The arrest report details similar allegations by all of the girls involving Alvarez touching their breasts over the clothing.   The reports states that a 10-year-old girl told Coral Springs detectives she reported the incidents involving the touching of the breast and vaginal area to “Ms. Maria,” one of the owners, and Maria told her she would tell her brother to stop.  However, the girl told police that Suarez Alvarez continued to touch her inappropriately and she witnessed him inappropriately touching other girls, as well.

Leonardo Suarez Alvarez is 52 years old and lives in Tamarac.  Twins Gymnastics is located at 1297 North University Drive in Coral Springs. According to the gym’s website (take down as of this date), it provide kids a “safe location” to “hang out after school.”

Like any other business, a gym is responsible for exercising care to protects the children under its supervision and must use due care in the retention and supervision of employees.  If the facts are that Twins Gymnastics allowed a volunteer to remain working at the gym after receiving a sexual misconduct complaint from a minor, an investigation in to whether Twins Gymnastics exercised adequate supervisions is certainly warranted.
