Judge to Set New Filing Deadline for Adults Sexually Abused in Rockville Centre Diocese

Judge’s Ruling Provides a Brief, Temporary Window for Some Additional Claims to be Filed in Diocese’s Chapter 11 Bankruptcy

Following the passage of a new law extending the time for certain victims of sexual abuse and assault to file lawsuits, United States Bankruptcy Court Judge Martin Glenn set a new filing for those sexually abused as adults (ages 18+) by a member or the clergy or a lay employee of the Roman Catholic Diocese of Rockville Centre. The judge’s ruling will allow additional filings for adult sex abuse claims for a limited time, thought the new deadline has not yet been set.  The Court previously ordered all such claims to be filed by August 14, 2021.

The Rockville Centre Diocese, which operates Catholic Churches in New York’s Nassau and Suffolk counties, filed its petition seeking relief under Chapter 11 on October 1, 2020. At the time, the Diocese faced more than 200 lawsuits filed by alleged victims of child sex abuse under New York’s Child Victims Act.  Negotiations are ongoing between the Diocese, its insurers, and the Tort Claimants Committee to develop a plan to resolve the bankruptcy and provide adequate compensation to claimants.

On May 24, 2022, New York Governor Kathy Hochul signed New York’s Adult Survivors Act (ASA), which gives survivors of adult sexual abuse (who were 18 or older when their abuse occurred) a year to file their claims, regardless of when the offense occurred. The one-year window opens on November 24, 2022.  Because the Diocese filed for Chapter 11 protection, it will be immune from additional lawsuit filings, but the new deadline to be set by Judge Glenn will provide a temporary opportunity for additional bankruptcy claims to be filed.

On July 17, 2021, the Diocese of Rockville Centre announced that Fr. Paul Butler, a priest assigned to St. Margaret of Scotland parish in Seldon, voluntarily resigned his position following an allegation of child sexual abuse.

The Diocese released very little information about the allegation except to say that it was made in a lawsuit filed by the alleged victim, who says that the abuse occurred in the 1980s when Butler was a seminarian.

The Diocese says that Butler’s faculties will be suspended pending its internal investigation.

Bp. Peter Libasci was ordained a priest in 1978, and served in multiple parishes in the Diocese of Rockville Centre. In December 2004, Father Libasci was named Honorary Prelate to His Holiness Pope John Paul II with the title of monsignor. In April 2007, His Holiness Pope Benedict XVI appointed Msgr. Libasci auxiliary bishop of the Diocese of Rockville Centre, followed by his appointment as the tenth Bishop of Manchester in September 2011.

According to media reports, in July 2021, Bp. Libasci was named in a lawsuit filed in NY Supreme Court alleging that he sexually abused a minor male on multiple occasions in 1983 and 1984. The boy, who was 12 or 13 at the time, was a student at the Saints Cyril and Methodius School in Deer Park, New York, which merged with another school to become Our Lady of Guadalupe Catholic School. The alleged abuse included fondling and groping the child’s genitals. 

Since the allegations involve a current diocesan bishop, the Diocese of Rockville Center, which includes Saints Cyril, reportedly notified the Vatican of the lawsuit, as well as to the Suffolk County District Attorney.

According to media reports, in February 2019, a woman alleged in a lawsuit that Mr. John Hanlon, the St. Agnes, parish janitor, sexually abused her as a 5-year-old girl. The alleged abuse occurred in the 1960s at St. Agnes in Rockville Centre. Years later, when she was 11, she and another woman claimed they were fondled in 1967, while being passed around the laps of priests at a Christmas party in the rectory.

Father James Devita was ordained a priest in 1957. According to media reports, in 1993, a woman accused him of abusing her 16-year-old son in the late 1970s.  She said the priest sexually attacked her son and left bruises and cuts on him during a pre-Christmas weekend trip. He was sent for six months of psychiatric treatment in 1993, and deemed fit to continue his ministry. He moved on to Venice, FL in early 1994. From there, he went to the Palm Beach Diocese in mid-1995. He served for five months at parishes in Royal Palm Beach and Wellington when the new allegations surfaced in October 1995, and he was removed from ministry.

In August 1998, Father Devita confessed to New Buffalo parishioners that he had a sexual relationship with a Kings Park teenager 20 years earlier. Shortly after his confession, the Kalamazoo Diocese received a letter from Bishop Robert N. Lynch claiming that an adult male had accused the priest of sexual abuse while he was pastor at Our Lady Queen of Apostles in Royal Palm Beach.

In 2021, his name was listed on the Diocese of Rockville Centre List of Clergy Credibly Accused of Sexual Abuse of a Minor. According to the list, the alleged sexual abuse occurred in multiple locations while he served at St. Rocco in Glen Cove, NY including at the parish, in Devita’s car, at a Catholic retreat, at Devita’s family member’s house and at a private home in Long Island. He is believed to be living in Boynton Beach, Florida.
