Boca Massage Therapist Donovan Washington Faces Sexual Assault Charges and License Restriction

Boca Raton massage therapist, Donovan Washington II, has pleaded guilty to sexual assault criminal charges after a complaint was filed by a female client he allegedly assaulted during a massage appointment on January 12, 2022 at Hand & Stone Massage and Facial Spa in Boca Raton, FL. Previously, onn March 31, 2022, the Florida Department of Health (DOH) ordered the Emergency Restriction of Donovan Washington’s license as a massage therapist, prohibiting his practice of massage therapy on female clients in the State of Florida. Washington has been a licensed massage therapist since March 2017 and has been an employee of Hand & Stone Boca since 2019.

Donovan Washington was arrested on January 12, 2022, after a 33-year-old female reported to the Boca Raton police department that she was sexually assaulted during a 60-minute massage given by Washington at Hand & Stone Massage in Boca Raton. The police report states that during the last 5-10 minutes of the hour-long massage, Washington asked the client to flip over to lay on her back. Washington massaged the client’s legs and worked his way up to the chest area. He then reportedly moved his hands under the sheet draping and massaged and rubbed the client’s breasts and nipples. The client reports that she became uncomfortable and asked Washington to stop. She then got dressed and stormed out of the spa to go directly to the police department.

Washington was arrested and charged with one count of battery.  He pleaded guilty on May 16, 2022  and was sentenced to six months probation plus community service. According to the police report, Washington admitted to the officer that he touched the victim’s breasts without her consent and that he did know it was wrong. A civil lawsuit was filed in March 2022 against Amerida Enterprises, the owners of the Hand & Stone Boca franchise, as they still allowed Washington to work at the spa, even after allegedly receiving a prior complaint of sexual misconduct. Washington was employed as the lead therapist at the Hand & Stone franchise.

Donovan Washington’s violation of the massage therapist-patient relationship indicates that he may lack the good moral character and judgment necessary to practice massage therapy. According to the Department of Health, Washington willfully abused his position as a massage therapist by inappropriately touching and sexually violating a client who trusted him to act professionally and within the boundaries of generally accepted massage therapy and treatment.

The Order ensures he can no longer pose a danger to the public’s health, welfare, and safety, pending a final hearing by the Department.  When clients book a massage, it is to decompress from the stresses of life. They trust that the massage therapists employed at the spa are carefully vetted and safe to engage with the public. It is unacceptable, immoral, and unlawful for any employee to touch a client in a sexual manner.

Ft. Lauderdale Massage Therapist Jesse Crocker Has License Revoked Due to Sexual Misconduct

On March 3, 2022, Ft. Lauderdale massage therapist, Jesse Crocker, had his license revoked following a disciplinary action brought by the Florida Department of Health Board of Massage Therapy alleging sexual misconduct at Hand & Stone Massage & Facial Spa in Davie, Florida. Crocker had been a licensed massage therapist in Florida since September 2016

A Final Order of discipline was entered following an allegation made against Jesse Crocker when he was working at Hand & Stone Massage & Facial Spa in Davie. An administrative complaint was filed in August 2021 after Crocker performed a 60-minute massage on a 25-year old female client. During the massage, Crocker allegedly exposed the client’s breasts, removed her facial mask to kiss her, and placed the client’s hand on his exposed erect penis. Crocker then allegedly reached under the sheet and placed his hand onto and massaged the client’s vaginal area. Afterward, Jesse Crocker reportedly stated, “I’m so sorry, I couldn’t control myself” and attributed his misconduct to “another form of stress relief.”  The client reported the incident to Hand & Stone that same day and canceled her membership.  Hand & Stone conducted an internal investigation and terminated Jesse Crocker’s employment.

The Florida Department of Health (DOH) issued an Emergency Order restricting Crocker’s massage therapy license on August 2, 2021, on account of this complaint. Crocker never replied and the Board of Massage Therapy did find the allegations were credible. Subsequently, Crocker’s license has been revoked, and he has to pay a $2,500 fine. He also must pay the investigation fee of $1143.

There are numerous pending civil lawsuits involving sexual misconduct against Hand & Stone franchises in the State of Florida. Under Florida law, massage therapists occupy positions of trust, and all sexual activity between the massage therapist and clients is strictly prohibited. 

Crocker violated the massage therapist-patient relationship according to his own admission to law enforcement.  A massage therapist may not use his relationship with a client to induce or attempt to induce the patient to engage or to engage or attempt to engage the patient in sexual activity outside the scope of practice or the scope of generally accepted examination or treatment of the patient.

Miami Massage Therapist Antonio Restrepo Gets License Revoked Due to Sexual Misconduct

On March 3, 2022, Miami massage therapist, Antonio Restrepo, had his license revoked following a disciplinary action brought by the Florida Department of Health Board of Massage Therapy alleging sexual misconduct at Hand & Stone Massage & Facial Spa in Miami, Florida. Antonio Restrepo, age 52, has been a licensed massage therapist in Florida since April 2018

A Final Order of discipline was entered following an allegation made against Restrepo when he was working at Hand & Stone Massage & Facial Spa in Miami. An administrative complaint was filed in September 2020 after Restrepo performed a full body massage on a female client. In the last five minutes of the massage, while she was lying face up, Restrepo allegedly rubbed the woman’s breast for one to two minutes and then began to touch her nipples. She immediately told him to stop the massage and leave the room. According to the Order, he then apologized, said he thought she was a beautiful woman and left the room. 

The Florida Department of Health (DOH) issued an Emergency Order restricting Restrepo‘s massage therapy license on October 29, 2020, on account of this complaint. Restrepo never replied and the Board of Massage Therapy did find the allegations were credible. Subsequently, his license has been revoked, and he has to pay a $2,500 fine. He also must pay the investigation fee of $2488.

Naples Massage Therapist Ermin Luis Surrenders License Due to Alleged Sexual Misconduct

Naples massage therapist Ermin Luis surrendered his license to practice massage therapy in Florida which was accepted and adjudged as discipline on May 14, 2021, by the Board of Massage Therapy. Following a disciplinary action brought by the Florida Department of Health Board of Massage Therapy alleging sexual misconduct at Hand & Stone Massage & Facial Spa, Luis voluntarily relinquished his massage license, agreed to cease practicing immediately, and not re-apply for a massage therapist license in Florida. Ermin Luis has been a licensed massage therapist in Florida since 2014.

Final Order of discipline was entered following an allegation of sexual misconduct made against Ermin Luis when he was working at Hand & Stone Massage & Facial Spa, located at 4868 Davis Blvd, South Naples, FL 34104.  On July 24, 2019, Luis performed a massage on a 17-year-old female client. During the massage, Ermin Luis allegedly removed the drape covering the girl’s breasts. He then reportedly touched her breasts and nipples. He was arrested and charged with Battery in Collier County in October 2019. He entered into a deferred prosecution agreement in February 2020. By signing this, Luis agreed that if he does not violate any local, state, or federal laws during a period of four months and completes 25 hours of community services, the criminal charges will be dropped. 

This was Luis’s second offense.  In 2014, just months after getting his license, Luis was arrested in Collier County and charged with one count of resisting an officer with violence. He pleaded no contest. His failure to report the incident to the Board of Massage Therapy violated Department of Health regulations.

The disciplinary order continues a long and disturbing trend of sexual misconduct by massage therapists statewide. Under Florida law, massage therapists occupy positions of trust, and all sexual activity between the massage therapist and clients is strictly prohibited.

Lake Mary Massage Therapist Alfredo Barreras Gets License Revoked Due to Sexual Misconduct

On May 13, 2021, Lake Mary massage therapist Alfredo Barreras had his license revoked following a disciplinary action brought by the Florida Department of Health Board of Massage Therapy alleging sexual misconduct at Hand & Stone Massage & Facial Spa. Alfredo Barreras has been a licensed massage therapist in Florida since 2014.

Final Order of discipline was entered following an allegation made against Barreras when he was working at Hand & Stone Massage & Facial Spa, located at 1210 International Pkwy S, Lake Mary, FL 32746. Barreras was arrested in Seminole County, Florida, on September 8, 2018, due to unlawful sexual contact with a 38-year-old female client during a 60-minute massage on August 7, 2018. The alleged victim told law enforcement that Barreras put his hand under the victim’s underwear and touched her vagina. He exposed her breasts and placed his mouth on both her nipples.

Barreras allegedly admitted to the sexual contact when interviewed by the Seminole County Sheriff’s Office on September 7, 2018. However, the Seminole County Sheriff’s Office gave notice on November 21, 2018, that they do not intend to file criminal charges against Barreras. The Florida Department of Health issued an Emergency Order restricting Barreras’ massage therapy license on November 28, 2018, on account of this complaint. 

Barreras never replied and did admit the allegations were credible; subsequently, his license has been revoked, and he has to pay a $2,500 fine.

Hand & Stone Massage Employee Disciplined for Sexual Misconduct in Winter Springs

On January 9, 2020, the Florida Department of Health issued an Emergency Order restricting the massage therapy license of Alexander Hyman due to sexual assault allegations lodged by a female client.  Alexander Hyman was employed at Hand & Stone Massage and Facial Spa in Winter Springs, Florida at the time of the incident in June 2019. The Emergency Order prohibits Hyman from practicing massage therapy on any female clients.

The Order was issued after Hyman, a licensed massage therapist, was accused by a female client of touching her vaginal area several times during the massage.  The client reported the assault to the receptionist after she left the massage room.  Hyman resigned from Hand & Stone Massage two days later.  According to the Department of Health, Hyman had been licensed to practice massage therapy since 2016.  This is just the latest in a long line of alleged incidents of sexual misconduct and abuse reportedly committed by employees at Hand & Stone franchise locations in Florida.

Clients of massage therapists are placed in isolated, vulnerable settings where they can be subject to abuse by their massage therapists. Due to the potential for abuse that is inherent under these circumstances, massage therapists must possess good judgment and good moral character in order to safely practice massage therapy and must refrain from placing their clients in situations that violate their safety and welfare.

LAKE MARY MASSAGE THERAPIST ACCUSED OF SEXUAL BATTERY

Massage therapist Alfredo Barreras is the most recent employee from Hand & Stone Massage & Facial Spa to be arrested on sexual misconduct charges in Florida.  According to law enforcement records, Barreras admitted to the sexual contact when interviewed by the Seminole County Sheriff’s Office on September 7, 2018.  However, the Seminole County Sheriff’s Office gave notice on November 21, 2018, that they do not intend to file criminal charges against Barreras at this time.  The Florida Department of Health issued an Emergency Order restricting Barreras’ massage therapy license on November 28, 2018, on account of this complaint.

Barreras last worked as a massage therapist at the Hand & Stone spa located at 1210 International Parkway South in Lake Mary.  According to law enforcement records, Alfredo Barreras was arrested in Seminole County, Florida on September 8, 2018, in connection with his alleged unlawful sexual contact with a female client during an appointment on August 7, 2018.  The alleged victim told law enforcement that Barreras touched her vagina, grabbed both of her breasts, and placed his mouth on both her nipples while she was there for a massage.   Barreras was also interviewed by law enforcement and reported that while he was massaging his client’s leg, his hand touched her vagina.  Barreras also said that while massaging his client’s shoulders, her breasts were exposed and this his mouth was over one of her breasts.  Barrera said he should have walked out of the massage but did not.

Health Dept. Finds Port Orange Massage Therapist Sexually Assaulted Patient

The Florida Department of Health issued an Emergency Order on July 25, 2018 restricting the massage therapy license of Nicolas Denis, Jr..  The Order states that Nicolas Denis, Jr. sexually assaulted a 21-year old female co-worker during a massage he was performing on her at Hand and Stone Massage and Facial Spa in Port Orange, Florida.  The Order finds that Mr. Dennis is an “immediate, serious danger” to public health.  As a result of the Order, Denis is prohibited from practicing massage therapy on female clients.  According to public records, Mr. Denis lives in Palm Coast, Florida.

The Department of Health Order states that during a massage on May 22, 2018, Nicolas Denis pulled back the woman’s underwear and “ran his fingers across her vagina, and then placed one or more fingers inside her vagina.”  The patient allegedly kicked at Mr. Denis and stated “No!”.  As the patient exited the massage room, Dennis reportedly told her that what happened there needed to remain between them. Mr. Denis was terminated from his employment at Hand and Stone Spa on May 29, 2018.
