It is a common misconception that bankruptcy means that a survivor of sexual abuse has no more recourse for what happened to them. That is not true. It means the claim will be decided in a more streamlined process in the federal bankruptcy court. But a very strict filing deadline will apply once set by the court; after that date (the “bar date”) the Diocese of Camden will be immune from lawsuits in all but the most limited of circumstances forever.

In February 2019, Bishop Sullivan released the names of 57 men that it said had been credibly accused of sexually abusing minors in the Diocese of Camden. The Diocese defined the term “credibly accused” itself, and had total control over the investigation into the credibility of the underlying allegations, just as it had exclusive control over the criteria determining which priests were identified on its list. This makes an independent grand jury investigation that much more important.
